WEBVTT 00:00.000 --> 00:06.900 It's saying that American citizens are now to be declared enemy combatants and treated 00:06.900 --> 00:10.560 as such through this presidential regulation. 00:10.960 --> 00:16.580 This is the True Health Report, where critical appraisal fuels true freedom. 00:23.860 --> 00:26.340 Hi, I'm Dr. Andy Kaufman. 00:27.100 --> 00:34.180 And today I'm going to talk about an important consequence of law that you may have an 00:34.180 --> 00:40.940 inclination about, but you probably don't really understand or know why this is the case. 00:41.200 --> 00:49.060 But have you ever wondered why it seems that many acts the government carries out are not 00:49.580 --> 00:52.300 consistent with what the Constitution says? 00:52.920 --> 00:57.820 In fact, many of you may have either heard of someone or done this yourself where you 00:57.820 --> 01:04.320 tried to make a constitutional argument in some kind of court case, and the judge pretty 01:04.320 --> 01:06.820 much threw it out or ignored it. 01:07.300 --> 01:13.940 Well, there is good reason for this, although it's not good in terms of justified, but it's 01:13.940 --> 01:17.660 good in terms of there is a clear explanation. 01:18.340 --> 01:24.980 And it really goes back to 1933, and today I'm going to tell you exactly what is going 01:24.980 --> 01:32.360 on with the Constitution and why it's essentially suspended in the present day. 01:33.200 --> 01:41.680 So before I get into the how and the why, let's just review some evidence that in fact 01:41.680 --> 01:46.760 the Constitution is not being followed appropriately in this day and age. 01:47.220 --> 01:54.580 So let me bring up some slides here with some quotes from the United States Constitution. 01:54.580 --> 01:59.020 So this is Article 1, Section 10, and it reads, 01:59.580 --> 02:07.240 no state shall make anything but gold and silver coin a tender in payment of debts. 02:07.740 --> 02:11.460 And this was always the case up until 1933. 02:11.940 --> 02:19.260 In fact, you used to be able to take a Treasury note or a dollar bill as it was pre-1933, 02:19.760 --> 02:24.380 go to the Treasury Department in Washington, DC, exchange it to them, 02:24.660 --> 02:29.080 and they would give you back the equivalent in gold or silver coin. 02:29.320 --> 02:33.880 After 1933, and you can certainly test this today if you like, 02:34.200 --> 02:39.480 if you take a dollar bill or any denomination thereof to the Treasury Department, 02:40.020 --> 02:44.040 you can in fact exchange it for another dollar bill, 02:44.040 --> 02:52.400 so another paper note rather than gold or silver because gold and silver coin is not being done 02:52.400 --> 02:58.960 presently even though it's required by the Constitution that it is the only kind of money. 02:59.440 --> 03:04.400 And we know this to be true because we know that we are no longer on the gold standard 03:04.400 --> 03:11.760 and this is the reason why we have such high degrees of inflation and deflation cycles 03:11.760 --> 03:20.120 and why the currency is being devalued and debased over time by simply creating more debt 03:20.120 --> 03:26.380 out of the obligation of the United States without having anything of real value that would count 03:26.380 --> 03:32.840 as actual money backing it up. So there's a lot of instability in the system and of course, 03:32.920 --> 03:37.120 there's a lot more to our financial system than this, but it's beyond the scope of 03:37.120 --> 03:44.040 today's presentation. So we have one clear section of the Constitution that is not currently 03:44.040 --> 03:52.900 being followed and let's look at another section. Now this is about the presidential powers and 03:52.900 --> 03:57.200 you can see here that it says the President shall be Commander-in-Chief of the Army and 03:57.200 --> 04:03.920 Navy of the United States when called into the actual service of the United States. 04:03.920 --> 04:10.560 Now how does the President get called into actual service? Well, it happens right here, 04:10.700 --> 04:18.720 it is a congressional power. So it says here the Congress shall have the power to declare war. 04:19.000 --> 04:26.360 So that means the initiation of an act of war has to come from Congress and then that power 04:26.360 --> 04:32.960 is delegated to the President to be the Commander-in-Chief of the Army and Navy and other 04:32.960 --> 04:40.600 branches of the military. Now what we've seen carry out in modern presidential term 04:40.600 --> 04:45.760 after another by multiple different Presidents is that the Presidents have unilaterally 04:45.760 --> 04:53.140 without the approval or order from Congress taken military action of war. Most recently, 04:53.320 --> 05:00.480 this occurred in Iran and it goes further than that because if we look in more detail here 05:00.480 --> 05:07.380 on this slide, it also says to provide for calling forth the militia to execute the laws 05:07.380 --> 05:14.180 of the Union, suppress insurrections and repel invasions and this is the doctrine that would 05:14.180 --> 05:21.220 have allowed the government to send military troops into Los Angeles recently during the 05:21.220 --> 05:27.800 immigration protests and quote-unquote riots. But in this case again the President took 05:27.800 --> 05:36.260 unilateral action rather than even asking the Congress for their approval. So we know from 05:36.260 --> 05:43.200 the President's actions in terms of these war powers that were granted to the Congress that 05:43.200 --> 05:48.460 the Constitution is not being followed. Now of course I could give many many other examples. 05:48.500 --> 05:54.540 In fact, if we look just at the 10th Amendment of the Constitution, we can find many many 05:54.540 --> 06:00.580 examples of government action and legislation that violate that 10th Amendment including most 06:00.580 --> 06:07.500 likely the Real ID Act and many many others. So it's pretty clear that many of the provisions 06:07.500 --> 06:14.100 of the Constitution are not being followed at present. So how can this be the case? 06:14.540 --> 06:20.180 So I want to direct your attention to this excellent analysis here. The war and emergency 06:20.180 --> 06:24.400 powers a special report on the national emergency in the United States and this 06:24.400 --> 06:32.740 largely draws upon a congressional report generated in 1973 that's referenced in here and is in the 06:32.740 --> 06:37.420 congressional record. So it's something you can find on the Library of Congress website. 06:37.620 --> 06:43.860 Now I'm going to show you a variety of quotes that are taken from the congressional record 06:43.860 --> 06:49.120 and let's start with this one. I think of all the damnable heresies that have ever been 06:49.120 --> 06:55.660 suggested in connection with the Constitution, the doctrine of emergency is the worst. It means that 06:55.660 --> 07:01.840 when Congress declares an emergency there is no Constitution. This means it's death. It is the 07:01.840 --> 07:06.700 very doctrine that the German Chancellor is invoking today in the dying hours of the 07:06.700 --> 07:13.140 parliamentary body of the German Republic. Now this of course was back in 1933 so we're 07:13.140 --> 07:20.180 talking about the Nazi party here and comparing the government powers to the powers of the Chancellor 07:20.180 --> 07:27.960 of Germany and that allowed obviously World War II and what happened in Germany to go forward. 07:28.080 --> 07:34.100 But we can see from this that the chief issue here is that when an emergency is declared 07:34.520 --> 07:41.400 it can suspend some and or all of the provisions of the Constitution. So could this be 07:41.400 --> 07:48.580 what's going on in the present day and age? Let us read further here because it says that 07:48.580 --> 07:56.120 since March of the 9th 1933 the United States has been in a state of declared emergency. Now that 07:56.120 --> 08:05.860 was stated in 1973 40 years later. So the emergency that was declared in 1933 that we're 08:05.860 --> 08:13.280 going to eventually get to remain in effect at least until 1973 but I'm going to argue that it's 08:13.280 --> 08:20.060 actually still in effect today and I'll show you the evidence to that and we can also read from 08:20.060 --> 08:25.680 the congressional record from 1933 that this vast range of powers taken together and this is 08:25.680 --> 08:30.760 talking about the emergency powers confer enough authority to rule the country without reference 08:30.760 --> 08:37.100 to normal constitutional processes. Under the powers delegated by these statutes the president may 08:37.100 --> 08:45.660 seize property, organize and control the means of production, seize commodities, assign military 08:45.660 --> 08:51.400 forces abroad so this is the unconstitutional power that I was describing in the earlier examples, 08:51.760 --> 08:57.700 institute martial law which is what happened during the COVID lockdowns, seize and control 08:57.700 --> 09:05.220 all transportation and communication, regulate the operation of private enterprise so that's a 09:05.220 --> 09:11.820 business in the private, restrict travel and in a plethora of particular ways control the lives 09:11.820 --> 09:20.440 of all American citizens and this situation has continued uninterrupted since March 9th of 1933 09:21.260 --> 09:26.120 and you know it goes on to further say that a majority of the people in the United States 09:26.120 --> 09:32.640 and at this point I would say 100% of the people in the United States have lived all their lives 09:32.640 --> 09:43.600 under emergency rule. So how did this mechanistically play out? Well it all originates with a reference 09:43.600 --> 09:51.740 in 1933 back to the trading with the enemy act of 1917 and this was an act passed by Congress 09:51.740 --> 10:00.440 at the outset of World War I to govern any business dealings primarily regarding foreign 10:00.440 --> 10:07.680 entities with which the United States may be at war with. And what it said in the important 10:07.680 --> 10:15.040 section 5B because this is the part that I'm going to explain is the key of this whole 10:15.040 --> 10:21.360 mystery. Okay it states here the president may investigate, regulate or prohibit under such 10:21.360 --> 10:28.320 rules and regulations as he may prescribe by means of licenses or otherwise any transactions in foreign 10:28.320 --> 10:34.520 exchange, export or earmarking of gold or silver coin or bullion or currency transfer of credit 10:34.520 --> 10:41.260 in any form other than credits related solely to transactions to be executed wholly within 10:41.260 --> 10:49.100 the United States. Now that highlighted language is key because it creates an exception that American 10:49.100 --> 10:56.320 citizens doing business with other American citizens are exempt from this regulation by the president 10:56.320 --> 11:03.180 and in fact in an earlier section of the original 1917 act it also states that U.S. citizens 11:03.180 --> 11:11.180 are an exception from the trading with the enemy's act in totality. Okay so what changed 11:11.180 --> 11:20.600 between 1917 and 1933? So in 1933 there was an amendment to the trading with the enemy's act 11:20.600 --> 11:28.160 and this here what I'm showing on this slide is actually Congress's approval of the amendment 11:28.160 --> 11:33.560 and what they say here is the actions regulations rules licenses orders and proclamations here to 11:33.560 --> 11:39.000 for or here after taken or promulgated made or issued by the president of the United States or 11:39.000 --> 11:44.680 the secretary of the treasury since March 4th 1933 pursuant to the authority conferred by 11:44.680 --> 11:53.180 subdivision B of section 5 once again 5B of the act of October 6 1917 which is the trading 11:53.180 --> 11:59.940 with the enemy's act as amended. Okay so in other words the amendment to section 5B 11:59.940 --> 12:07.400 is included in what Congress is talking about here are hereby approved and confirmed so the 12:07.400 --> 12:14.200 president amended the trading with the enemy's act section 5B and this is Congress approving it 12:14.200 --> 12:20.020 and in fact this is in the United States code presently the this approval of the amendment 12:20.020 --> 12:28.360 it's in title 12 section 95 subsection B so you can look that up if you want but that's where 12:28.360 --> 12:36.600 this text is taken from so what is the amended language it is right here is the amended language 12:36.600 --> 12:42.800 that was approved by Congress and so this is section 5B of the trading with the enemy's act 12:42.800 --> 12:47.880 and the first part is the same right here that during a time of war 12:47.880 --> 12:53.320 or any other period of national emergency declared by the president so the president has 12:53.320 --> 13:00.320 the power to declare the emergency and then is given these emergency powers once the emergency is 13:00.320 --> 13:06.020 declared which include that they may themselves or through any agency they designate investigate 13:06.020 --> 13:10.880 regulate or prohibit under such rules and regulations as he may prescribe by means of 13:10.880 --> 13:16.060 license or otherwise any transactions in foreign exchange transfers a credit between 13:16.060 --> 13:21.200 or payments by banking institutions as defined by the president and export hoarding melting or 13:21.200 --> 13:27.200 earmarking of gold or silver coin or bullion or currency by any person within the United States 13:27.200 --> 13:35.880 or any place subject to the jurisdiction thereof so now the exception for transactions in the 13:35.880 --> 13:42.400 United States among American citizens is gone so this amendment essentially applies 13:42.700 --> 13:49.640 the trading with the enemy act now to Americans directly so in other words it's saying that 13:49.640 --> 13:57.340 American citizens are now to be declared enemy combatants and treated as such through this 13:57.340 --> 14:06.060 presidential regulation so all of commerce banking finance is under this provision right 14:06.060 --> 14:13.300 now this emergency regulations and this is how we're able to have transactions without gold or 14:13.300 --> 14:19.380 silver constitutional money because the president made up different rules that we have to follow 14:19.380 --> 14:26.740 and are subject to you've seen it all fall apart medicine education science government 14:26.740 --> 14:32.900 all upside down all corrupted all hollow you opt it out even when your friends called 14:32.900 --> 14:37.520 you paranoid even when your family stopped inviting you which i believe is also proclamation 2039 signed by fdr forbidding the hoarding of gold coin 16:48.960 --> 16:54.200 gold bullion and gold certificates within the continental united states and this was carried 16:54.200 --> 17:00.220 out under the authority of the trading with the enemy act of 1917 as amended by the emergency 17:00.220 --> 17:05.540 banking relief act and that's where that uh statute where the congress approved the amendment 17:05.540 --> 17:13.080 was originally codified so here we have an example of the president being able to order 17:13.080 --> 17:19.440 basically everyone's gold and silver to be seized by the government taken away now they did pay a 17:19.440 --> 17:25.760 nominal price and then as soon as they confiscated all of the gold they raised the price of gold 17:25.760 --> 17:32.260 so what the government now had was much more valuable in terms of purchasing power at that 17:32.260 --> 17:38.280 time so we can see here this power was not granted under the constitution and would be illegal right 17:38.280 --> 17:45.000 because the president has no authority to seize property from the citizens but because of this 17:45.000 --> 17:53.580 emergency situation and suspension of the constitution now property can be seized because of this 17:53.580 --> 18:00.460 emergency situation and i just want to follow up as what has happened since then because 18:00.460 --> 18:09.160 some sources and some legal scholars may say that the emergency from 1933 has actually 18:09.160 --> 18:16.340 ended at this time and is no longer in effect so this is another report from the congress 18:16.340 --> 18:22.800 and you can see at the top that i got it from the library of congress website because in the 18:22.800 --> 18:29.620 late 1970s there were two acts that were passed with regard to national emergencies that 18:29.620 --> 18:37.780 were trying to limit the powers of emergencies because what congress found in 1973 right with 18:37.780 --> 18:45.700 this emergency carrying on for four decades is that there was a rife opportunity for the president 18:45.700 --> 18:51.400 to take advantage of this situation and do things which were not justified so they tried to put 18:51.400 --> 18:56.640 some limits but these limits were mostly lip service in my opinion you can certainly look 18:56.640 --> 19:02.220 into the details but i think here is the key finding that is from this congressional report 19:02.220 --> 19:07.140 that the NEA they're talking about the national emergencies act that's one of the two acts that 19:07.140 --> 19:12.540 was passed to try to put some limitations on power during emergencies but it provided for 19:12.540 --> 19:20.320 the termination of all existing emergencies in 1978 except those making use of section 5B 19:20.320 --> 19:26.680 of the trading with the enemies act so in other words the 1933 banking emergency that i was just 19:26.680 --> 19:34.400 discussing in any other emergencies in 1933 that referenced that amended section 5B of the 19:34.400 --> 19:41.060 trading with the enemies act allowing the president to treat united states citizens as enemies 19:41.060 --> 19:49.420 remains in effect today and this is why we still have no gold and silver coin that is money 19:49.420 --> 19:55.540 we only have paper debt instruments circulating around being called money or being called legal 19:55.540 --> 20:05.320 tender so where does this leave us today well it leaves us with another 50 plus years of 20:05.320 --> 20:12.100 the national emergency i mean we're really approaching almost 100 years from 1933 for 20:12.100 --> 20:20.800 this emergency banking situation but in addition to that let's look at the current 20:20.800 --> 20:28.480 emergencies that are still in effect today so once again there's a wikipedia page 20:29.120 --> 20:33.600 here which is a list of national emergencies in the united states so we can just go to 20:33.600 --> 20:39.720 mainstream sources and we can go back of course here to 1917 where the trading with 20:39.720 --> 20:46.860 the enemies act was first passed and in this first column status ended it may not be accurate in all 20:46.860 --> 20:54.940 cases because if we go right here what we just talked about in 1933 which references proclamation 20:54.940 --> 21:01.320 2039 it said declared a bank holiday from march 6 through march 9th using the trading with the 21:01.320 --> 21:10.000 enemy act as a legal basis the first of four emergencies reported senate report 93 549 which 21:10.000 --> 21:18.180 i've already referenced 1973 as never having been terminated so it puts ended here but it says here 21:18.180 --> 21:23.380 that the senate says that it hasn't ended and we've looked at further evidence to know that it 21:23.380 --> 21:28.680 actually hasn't ended so we are still under this emergency now some of these other fdr 21:28.680 --> 21:34.940 emergencies may also still be in effect if we look at them if they reference section 5b of the 21:34.940 --> 21:40.580 trading with the enemies act they're still in effect but if we go down further we can see that 21:40.580 --> 21:47.440 even wikipedia concedes and a quite a large number of emergencies are still ongoing so we have 21:47.440 --> 21:53.860 this is the oldest one it says is still active and this is from 1979 and it has to do with 21:53.860 --> 22:01.140 the us and iran now we can actually find other emergency declarations having to do with iran 22:01.140 --> 22:07.400 here we have many more emergencies this one due to weapons of mass destruction under clinton 22:07.400 --> 22:15.060 we have several more from clinton involving iranian petroleum narcotics traffickers this has 22:15.060 --> 22:22.560 to do with shipping vessels still in effect here something with sudan an emergency still 22:22.560 --> 22:29.160 in effect now if we're in the bush era we can see here that there's with the western balkans 22:29.160 --> 22:36.480 export control regulations terrorist act emergencies and of course this as you might expect would 22:36.480 --> 22:45.080 suspend substantial constitutional protections here more related to terrorism and we can keep 22:45.080 --> 22:50.520 going on to the present day bush has quite a number of them then we get into obama 22:50.520 --> 22:58.080 obama i think has more than from the first trump term from biden's term so we can see that we're 22:58.080 --> 23:06.160 talking about dozens of emergencies in addition to the 1933 emergencies that are still in effect 23:06.160 --> 23:10.700 and if we look under the most recent and current trump administration right which 23:10.700 --> 23:18.340 has only been in effect for a little over six months we can see quite a number one two three 23:18.340 --> 23:26.440 four five six seven eight eight national emergencies declared through executive orders 23:26.740 --> 23:35.700 by trump in fewer months than that what we can see from this exercise in legal scholarship 23:36.380 --> 23:45.800 is how we the people living in the united states have been completely duped and hoodwinked out of 23:45.800 --> 23:55.180 our rights by the heresy of a declared national emergency and this is done in a clandestine 23:55.180 --> 24:01.800 manner so that it's not talked about every president that comes along continues to renew 24:01.800 --> 24:08.780 these emergencies because they have to be renewed on an ongoing basis they don't publicize it there's 24:08.780 --> 24:15.980 no white house press secretary no photo op of them renewing these emergencies but this is what gives 24:15.980 --> 24:22.880 them unchecked and unfettered power outside the us constitution now of course there are 24:22.880 --> 24:32.000 remedies for us in dealing with these atrocities which is you know for a different discussion but 24:32.000 --> 24:41.320 it is so important that we understand and become aware of this situation so that we know how to 24:41.320 --> 24:48.840 protect ourselves what is right and if we want to try to take action we at least know 24:48.840 --> 24:56.900 or have an inclination of what we're trying to overcome in that action so make sure to watch this 24:56.900 --> 25:04.200 a couple more times so everything sinks in i might have gone over some of the quotes and the statutory 25:04.200 --> 25:11.480 another
